Audiosurf Videos on YouTube & Copyright Issues

In light of Razaeria's sad post on the termination of his YouTube account for copyright violations I have some helpful advice. It would be best to research videos for a song that you want to record on Audiosurf before actually recording them. Try to find links to purchase the songs on iTunes, Amazon, Android Market or some other site below the videos on the right side. The links indicate that the video for the song is being monetized by the copyright holder and is not being blocked worldwide. If the videos for the song you want to record does not contain links chances are high that the video will be blocked worldwide. I don't try to figure why the video exists. It's possible that a video will be blocked in select countries even if you see links to purchase the song in your country. This is a recent strategy I have utilized and each time the video has been monetized, not blocked. This generally applies to mainstream artists and their songs. This copyright issue usually doesn't occur with indie artists.

I understand that YouTube users are disappointed and outraged by YouTube copyright policy. However, it is not YouTube's fault. YouTube has to implement a copyright policy in order to protect its business from lawsuits. If you receive 3 copyright strikes your account will be terminated. You receive copyright strikes if you choose to file copyright dispute claims with the copyright holders for videos that are blocked worldwide. It is not YouTube's determination whether your video is infringing an entity's copyright. YouTube is issuing copyright strikes at the request of the copyright holders.  ;)

So having a video banned does not equate to a strike, but a failed protest for fair usage does?
Austria is just like Yorkshire, but they have bigger hills.... oh and they have real snow too

Having a video banned gets you an immediate strike.  I haven't tried claiming fair use so I can't answer the second part of your question.  I do know that in the absolute worst case, misusing it could land you in court.

Also, it looks like strikes expire after a while...  I just went to check on my account and it says I have none.

Did you delete the 'banned' video?

Deleting a banned video has no effect on the copyright strike. I surmise that Jagori received a strike years ago and that was before YouTube modified its policy on copyright strikes. The copyright strike can be removed from your account after a indefinite period of time if you upload many videos without receiving another strike. In addition, you must successfully complete copyright school by answering questions on a quiz. However, the removal of the copyright strike is not guaranteed and YouTube is not clear on how long the strike will last. I joined YouTube in July 2010 and I had uploaded several videos that were blocked worldwide without receiving a copyright strike. I claimed fair use and most of the videos were eventually monetized. One was muted 8 months later and I deleted it without ever receiving a strike. I recently learned that years ago you would receive a copyright strike for simply uploading a video without claiming fair use. YouTube's policies change very quickly over time. As it stands in 2011, you risk receiving a copyright strike if you decide to file a copyright dispute claim with the copyright holder. When you receive a copyright strike under the new policy you will immediately be sent to copyright school to answer questions on a quiz. You can't upload another video without passing copyright school. Passing copyright school is only one step in trying to get the strike removed. The other step is to upload many videos without receiving a copyright strike again. It ultimately will be up to YouTube to determine whether the copyright strike should be removed.

Can take the easy way out and only upload non copyrighted music or possibly audio swap?
(I'd rather just avoid it at all costs)

It's possible that ads appear on the right side next to your video when the video plays. Some companies have ads next to the video and no links to iTunes or Amazon. That's how it is with two of my Resident Evil 5 videos.

I am a college student majoring in accounting. I try to use the internet to gain as much knowledge as possible on a variety of subjects. If I feel like sharing my knowledge with you like I am doing with this thread I'm willing to share it with you.

The video I got a strike for had that warning too, and it stayed up for a couple months before getting taken down without any other warning.  It's the only video I've ever posted that had Sony Japan as the copyright holder, though, so I guess they're more proactive in stopping this menace to the music industry that we Audiosurfers present.

i get a notice about 50% of my videos and i got 37 AS vids sofar, only ever had one completely banned, but i got a lot of vids that are banned in Germany, and have  1 vid that is banned everywhere but Canada.

would i be getting strikes for those, or only teh 1 worldwide baned vid.
